New French hourly rates and higher penalties for infringement of “Loi Macron”

New French hourly rates

The French Official Journal has published last September 20th, 2018, the extension of an amendment to an agreement concluded within the framework of the national collective agreement for road transport and auxiliary transport.

The agreement published on March 6th, 2018 was focused on the re-evaluation of conventional remuneration.

From now on, the hourly rates to indicate on posting worker declarations, are the following:

Posted workers and office clerk workers. Hourly rates as of April 1st, 2018 (in Euros).

 

Compensations for Sundays and holidays worked:

  • working time less than 3 hours: 10,22 €;
  • working time equal to or greater than 3 hours: 23,77 €.

Higher penalties for infringement of “Loi Macron”

The French Official Journal has published last September 6th, 2018 Law n° 2018-771 of September 5th, 2018 for the freedom to choose one’s professional futureChapter III: Measures relating to the posting of workers and the fight against illegal work” which introduces higher penalties for violation of provisions on the posting of workers.

Loi Macron finesIn case of no respect of one of the obligations of posting works mentioned in art.le L. 1262-2-1, art.le L. 1263-4-4 or art.le L. 1263-7, the amount of the fine can reach up to 4.000 € per posted worker and up to 8.000 € in case of repeated infringements within two years from the date of notification of the first fine. The total amount of the fine cannot exceed 500 000 €.

These penalties will not be applied to haulers before publication of the executive decree in the French Official Journal.
